HARRE CONSULTING provides consulting services to contractors in claim preparation. In addition, we assist contractors and owners and their counsel in construction disputes and litigation. Our services include fact-finding, as well as analyzing, quantifying, and presenting claims. Further, we challenge opposing party claim methodology and quantify alternative claim positions.
In false claim matters, we evaluate alleged False Claims Act allegations at the request of counsel, perform compliance reviews of practices to assess the risk of potential false claim allegations, assess the potential for an affirmative false claim action against another party, and help contractors manage the risk of false claim exposure in the changed-work claim preparation and other aspects of the contract process.
Our professionals are experienced in:
- Analyzing bids, budgets, previously negotiated contract modifications, and actual costs for changed-work claim preparation and evaluation purposes.
- Developing procedures and practices for claim preparation to ensure that claims are reasonable in relation to the original bid, and in relation to negotiated contract changes, historical and projected financial data, contract events, and contract facts.
- Preparing and evaluating delay and disruption claims, based upon, among others, the "measured mile" methodology and the "Eichleay" overhead methodology.
Our professionals have assisted contractors in assessing contract risk prior to bid submission, developing systems and controls to better manage risk, and monitoring performance. They have testified on construction costs, claims, and contract and project management matters in Federal and State Courts, in administrative proceedings, and in arbitration. Moreover, they have made formal presentations and participated in settlement negotiations, mediations, and other alternative dispute resolution proceedings.
